Dear All,

One of our lady employees has applied for Maternity Leave for 3 months, and her leave has been granted by the management. As per our HR practice, employees are entitled to get 32 days of leave annually. Is she supposed to get this leave separately, or can it be included with her maternity leave?

As per the Maternity Benefit Act, a woman who is not eligible for Maternity Benefit under the ESI is entitled to leave with benefits at her salary for 84 days, plus an additional 30 days of benefits for sickness arising from delivery. The other leaves to which she is entitled cannot be substituted for leave under the Maternity Benefit Act.

Dear Chakraborty,

Please note, Maternity leave is applicable separately from PL or any other leaves as per your company policy. Maternity leave lasts for 81 days. For more information, refer to the Maternity benefit quotes.

First of all, you should know about the types of leave, such as CL, EL, SL, and Maternity Leave. Maternity and other leaves are separate, so you have to give her 32 days of leave other than maternity leave.
