Dear all,
we have diesel generator assembling unit registered under factories act 1948, where 70 employees are working . we have separate marketing team for the generator sales , for them we have separate office which is located other area. can any one clarify me weather it should be covered under shops and establishment or factories and establishment .
For factory employees we are following as per the factories act (Leaves , attendance , wages etc..) can we follow the same for marketing employees or we should follow shops and Establishment rules.

Shop &comm:est act of your state applies to your marketing division.If employees are transferable between your factory and mktg division you should follow same leave policy.

Your marketing office will be liable to be registered under the Shop and Commercial Establishment Act of the State and as far as question of leaves balance, the leave will be governed in accordance with the Shop and Commercial Establishment Act for the employees working in marketing office.
