My Self Bhajneet Singh. I was working in a Pvt Ltd organization in Sonepat.
Few days back due to some reasons I resigned in writing with one months notice period as described in my joining letter. during the notice period I was on leave for 6 days without intimation as the EL or SL are not provided in the organization. in my salary 6 Leave Without Pay is shown (i.e. deduction were made) and in full and final sheet they told me I also have to bear extra 6 days deduction in F&F as I was not present during the notice period. By this they deducted total 12 days salary for taking 6 leaves during the Notice Period. When I asked them about the extra deductions the said it is as per law.
You are requested to please guide me in the above matter.

During notice period, only EL can not be availed as per few States Shop & Establishment Act, But an employee can avail SL/CL.
And there is no such law which provide deduction of 12 days wages on account of 6 days leaves. As you were on leave with out intimation, they might have imposed it as a fine, if its mentioned in their Standing Order.
But still you can speak to them or can have help from Labour Inspector.

as per appointment letter ( what they mention if you not serve notice period to company ) based on that they might have deducted your salary sir first you just go throw your appointment letter

Hi Baljeet,
I assume that 6 days were unpaid for the simple reason of being absent without any paid leave in your quota.
Another 6 days deduction would probably be due to 30 days notice not served in full as you were absent for 6 days so they deducted 6 days pay for short notice served. Check the appointment letter, it might be written over there that during notice a person has to work on all the open days.
In case of dissatisfaction, you can file a complaint with local labor officer and hope for the best.
