This is Gurunadh working in univercell telecommunication my joining date is 1-10-2008 total 3.5years working in univercell store manger of gudiwada branch on mar 02-2012 my area sales manager says i am transfers to machilipatnam location on spot i replay my wife is pregnant so i need time to change location but he not heard so final he says u may go to transfer or resigned the job so i placed resignation to her and noticed period of 1 month on apr 01- 2012 my noticed period over i will be at home but on this month my salary not cr i call to hr , he says it will come on f&f so follow up every one in organization to settlement i given all documents of audit reports / Clarence letters / no due certificate / nill variation mails but still now i am not getting my settlements so pls help me how get my settlements , and company not paid incentives of Rs.95000 how can calim my incentives

You better to approach labour department as per the Act they have to settle f&f within second working day itself and all those u r mentioned in the mail no due certificates etc. is strength for u.

Transfer is an incidence of service. Machilipatnam is not that far from Gudiwada. Probably you could have managed your transfer back with some persuation with HR. Since you resigned now and F&F is not yet settled, you wnat to know what is the remedy for you. From the details provided by you in your post, it appears yo were holding a managerial position. If so, you cannot invoke any remedy under the Industrial Disputes Act 1947. Therefore, try to explore whether there exists any remdey under A.P Shops and Establishments Act. The Shops Acts of some states provide for a machnism for settlemnt of diputes including termination. The A.P shosp Act might similarly have some provision. If so, you can invoke a remedy under it. Otherwise, you have to file a suit.

Unicellular is a large company with systems and processes in place. Have you called hr department and spoken to them ? Ask them why there has been a delay ?

Go the office and meet the HR and get cleared why ur f&f is on hold. Maybe they have some query which can be settled only after meeting personally...
