Dear Sir,
We are working in a construction company. As esi is not applicable on workers in construction company. Bur our Principal employer is saying that they are covered under esi act and they have taken esi no. It is necessary for thier sub contractors to be convered under esi act . Please help me in this mateer

Dear Tanuj,
It is mandatory to take ESIC coverage, if the Principal Employer is covered under the same act. However, alternatively, there is an option to take W/C Policy for your workers, if the principal employer doesn't have any objection on that...
In this regard, your company would come under BOCW Act as well.

Definitely, it is covered under Building and Construction Workers Act, both contractors and subcontractors are entitled for the benefits... (not under ESI)
