Hi All,
I have a query that if a worker cover under ESIC act in Himachal Pradesh than he is elligible for Sick Leave as per Holiday and Festival Act applicable at himachal Pradesh. in this regards can any one share the detail of section where it is mentioned that Sick leave not applicable if worker cover under ESIC act.
I need this urgent basis.
Please share ASAP.

If the basic Act (the ...state Shops and Commercial Establishments Act which is an Act to to regulate the conditions of service and to ensure welfare, health and safety of workers employed) has provided for sick leave, you are supposed to give it to all employees including ESI covered employees. In respect of such employees, invariably, you are not paying wages for the days they remain on ESI leave.

Dear All, Would like all of your advice on below mentioned query:- 1-In case if an employee met with an accident, What is the maximum time in which an accident can be reported to ESIC? I suppose according to ESIC act, accident has to report within 24 hours to the branch office. if the accident happen on Friday night and Saterday will be factory W/O then Sunday is govt holiday what should be done? 2-What type of accident we have to report? how can be distinguish that this accident should be reported or not? and are the same accident report submitted to DISH under form 24 though the accident is minor injury like skin cut , bodily part strain, etc.in the common accident register for ESIC and MFR 1963 3- sometime the injury has minor /not serious but the workman force to fill the ESIC form due to sick leave, how to prevent or face such type of matter .
I would appreciate your prompt response on it.
