[Tamil Nadu Shops & Establishment Act]
We are running a showroom with 3 staff and 2 carpenters. The holidays listed for 2012 are 12 days. Staff leave is allowed for 24 days per year. For carpenters, along with the holidays, how many days of leave can be allotted?
Kindly forward your suggestions as per the act.

Dear Nalini,
I hope this is regarding the furniture showroom. Are the carpenters on the company payroll, contract basis, or paid daily wages?
For those on the company payroll, they should be treated like other sales staff.
Regarding contract workers, the contractor will manage their replacements in case of absence.
As for those paid daily wages, a day off should suffice for 6 working days. If they take additional leave, you can deduct their salary accordingly.
Thank you.

Dear Nalini,
Yes. Since you would have given them an Appointment Letter/Confirmation Letter where you would have mentioned all the benefits that will be given to the employee, you have to abide by the same.

Dear Sir,
Please suggest me regarding the salary structure.
We are an Engineering Company with a team of 20 members:
- Staff: 15
- Operators: 2
- Contract employees: 3
- Others: 2
We do not need to comply with any government regulations because in the Machinery unit, we have 5 members, and the remaining 17 are in the office.
The pay structure for staff is as follows:
- Basic & DA: 40%
- HRA: 15%
- Local conveyance: 15%
- Other allowances: 30%
The salary range is Rs. 10,000 to Rs. 40,000.
Is the current breakdown satisfactory, or should we make changes?
Thank you,
Nalini

Dear Nalini,
You can go with the following breakdown:
- Basic + DA = 60%
- HRA = 20%
- Conveyance = 10%
- Medical/Other allowance = 10%
I hope your organization is growing. Regarding ESI, I understand that the ESI Department is considering changing the minimum employee requirement from 20 to 10, which might come into effect in 1-3 months. Under the PF Act, if your salary range is between 10,000 - 40,000, you might have only the minimum number of employees for contribution. Many employees may have a basic salary above 6,500, where you can either get an exemption from PF contribution or contribute a maximum of Rs. 780.
Alternatively, you could consider the following structure:
- Basic = 50%
- HRA = 30%
- Conveyance = 10%
- Medical/Special allowance = 10%
