If any employee is taking leave from Monday to Saturday (6 days), shall we count the prefix and suffix Sunday, or will it be treated as a holiday? When there is no PL/CL/ML balance, please guide on what it is as per acts.

As per the Factories Act, an employee who works for 48 hours is to be allowed one day off with pay. If the employee is on EL/PL for 6 days, then he is eligible for a weekly off with pay. If he is other than PL/EL, then the weekly off after the leave is also going to be loss of pay. The implication shall be with Suffix; you have to consider the prefix as a weekly off only.

If it is SL, the employee has to apply the Sunday also as SL, i.e., 7 SLs. In general, CLs will be allowed for a maximum of 3 days, and the other 3 days are going to be loss of pay. Then the weekly off is also treated as loss of pay because there are no working days in the week; hence the weekly off with pay won't arise.

Please clarify what you are saying. Let us consider one example. Suppose employee X is on leave for 8 days, from Tuesday to Tuesday. If his leave balance is sufficient, 8 days will be deducted from it. If his leave balance is insufficient, he will be without pay for 8 days.

Dear Vineet,

You just need to know the meaning of the terms "prefix" and 'suffix' and nothing else. Your case does not fall within the purview of either prefix or suffix of Sunday. Any Sunday or holiday falling in between (NOT before or after) the duration of leave has to be treated as part of that leave.
