Dear all, please provide suggestions in a case of termination. in my company management has decided to scrutinize some employees during the appraisal time, they were mailed a notice regarding their 1 month provision for performance review and after that they were pressurized to resign, finally 6 employees were out of service, some of them were working since 3 years but my friend was just 6 months old though his conformation was pending, but i don't find any reason for such an action, it seems that company just removed his extra burden. so please tell me whether an employee if do not want to leave his job or resign, could the employer force fully terminates him and on what grounds. also suggest the measures for employees protection.

If an employer wishes they can terminate under disciplinary Grounds and non performance or under performance reasons. If the employee is releaved due to over staffing means the employee will get all the benefits (Notice Pay, Leave Pay, Retrenchment Compensation, Gratuity). But your friend cannot claim for re-employment as the company has removed due to extra burden (cost control).
Further let your friend check the offfer of employment on probation for any termination, resignation, notice period details, any compensation details, etc., for seeking redressal of grievance.
