The gratuity is payable only on(1) attaining the age of superannuation (2) on retirement (3) on leaving the services of particular employee that too after completion of 5 years of contineuous service. (4) in case of death.
If your issue is falling in any of the above, you will certainly get the gratuity. Else not.
