Mostly people are of a view that the Gratuity is payable only incase the employee has completed 5 yrs of a continuous service with a company. But there are two more conditions where the company is bound to pay Gratuity to its employees: a). In case the employee die on duty, & b). In case the employee has totally disablement while on the job. You can go through the Payment Of Gratuity Act. Now a days, LIC is also covering the payment of gratuity for the employees. I invite the comments of my seniors to correct me if i'm wrong. Regds, Komal

Dear If a person had worked for 4 years and 245 days; he shall be eligible for payment of Gratuity. In case of death before the 5 years; he shall be eligible for gratuity. Gratuity is calculated : Last Basic+DA divided by 26 multiplied by no. of year of service and than divided by two. Pl note if in the last year he has worked more than six months, it will be counted as full year and if less than six months, it will be ignored ak malhotra
