Whether Earned Leave encashment is permissible under Labour Laws or not. I need clarification for this with supporting judgements if any passed in the Judicial Courts. K.Sundararaman DGM(HR), Floram

Normally, the workmen are engaged on a temporary basis. For them, the weekly off is being paid based on their attendance, as the monthly wages are divided by 26 days and paid for the number of days present. Hence, the weekly off is paid along with equated daily wages. If they work on Sundays, the wages will be paid double the amount.

Furthermore, they are eligible for Leave Wages at the time of retrenchment, resignation, termination, retirement, or dismissal. Whatever the circumstance may be, they must be paid one day's wages for every completed 20 working days they have worked.
