The method of pressurising to rsign on cell even otherwise is not appropiate. How ever;
Why is your employer pressurising to resign? Is there any issue with your performance, discipline, ?/ is the business not doing well?/.
Also kindly clarify what kind of firm company you are working and in what category you are working as. Based on the above only a definite suggestion could be given.

i work in financial services space at cochin.i am the operations head and and i am working in this company for the past 16 years without any break. i was instrumental for development of other business verticals as a support function. no there is not an issue with performance,discipline and business is doing well. i have devoted much of the full 16 years for the development of the company.
Second,there is group next to ceo which manages the branches and they are against me for reasons known to them and i understand they have submitted negative reports on me to ceo. Please guide me on whether I should submit resignation/ask them to issue termination letter and take legal recourse. I also understand that they want to transfer me to avoid me taking legal recourse
Please advise

Hi,
Going by your mail, I consider you to be working in a senior managment postion. As such there would be no prtoection under the Industria Disputes Act, though you may initailly file a case.
But keeping your 16 years of service record in mind , which is unblemished, you can definitely ask them in writing the reasons why you are being insisted to resign.
Asking them to issue a termination letter is totally not advised as this would have definitely negative effect on your future employment prospects.
I would also advise you to have a one to one meeting with the CEO and make a plain talk explaining your stand and request for a chance to reply on the negative report if any against you.
If these do not work out then request for a decent way of separation with sufficienct notice time to get a job and move on.

Dear Sir
Today there was a mail from hrd asking me to submit my resignation and relieving me on 31st august. further they informed me that another month salary will be paid as a part of seperation .
i had insisted on reasons for submission of resignation and they informed that total support to staff and performance which i replied as not acceptable. they failed to divulge further.
pls advise do i need to submit resignation on my own or take legal recourse.

I had finally quit on Aug 31st 2010 and sent my final settlement papers. Yesterday it was received at my Ex-employers branch and again the CEO had asked my Ex-HR to send it back and stop payment on grounds that I am taking people from the company.
Please advise,whether they can stop my final settlement,any legal remedy is available if they stop it.I tried to talk to CEO but could'nt get him across online ,sent an sms and he replied that he will call up on Monday. As on date,I have'nt hired any resources from the earlier company though I have started on my own.
Please guide me up.

Hi,

your CEO Doesn't have right to hold your final settlement, you can seek Adjudication body help to recover your final settlement and seperation allowance from your Employee . For your reference i am quoting this caluse

33C. RECOVERY OF MONEY DUE FROM AN EMPLOYER. - (1) Where any money is due to a workman from an employer under a settlement or an award or under the provisions of Chapter VA or Chapter VB, the workman himself or any other person authorised by him in writing in this behalf, or, in the case of the death of the workman, his assignee or heirs may, without prejudice to any other mode of recovery, make an application to the appropriate Government for the recovery of the money due to him, and if the appropriate Government is satisfied that any money is so due, it shall issue a certificate for that amount to the Collector who shall proceed to recover the same in the same manner as an arrear of land revenue :
Provided that every such application shall be made within one year from the date on which the money became due to the workman from the employer:

Thanks for the advise. Further the CEO of Ex-Employer had called me up yesterday at 6.30 pm at my mobile and he informed the following.
1.He wont pay a paise towards single settlement on the following grounds and he made all baseless and frivolous allegations
a] That I have poached his employees as per information given to him by his Branch Coordination team.
b] That I have said wrong about his company to his clients that people have left the company.
c] That he using his powers and strength and contacts will ensure that I am out of the new assignment and will also ensure that I dont get a job anywhere.
d] That one of his branch coordination team officials will be in cochin and that I will have to meet them and until its proved that I dont interact with any of past/present employees,he wont release a single paise of settlement /relieving letter etc . He may extend this as a part of monitoring my movement till 6 months i.e,April 2011.
e]That I am not supposed to complain to any one in Corporate office or branch on this also about the call.
He has'nt given anything in writing inspite of my repeated mails to him. Post my resignation mail,he had given in writing in mail that three months will be paid as a part of severance from the company immediately
I responded that I dont need any of his staff and that I am into a different line of business and I am totally out of the interactions with his staff and also begged him to clear my settlement inview of financial problems at home,this be released immediately for which he was threatening of dire consequences.
Please advise me how to come out of this. I am mentally tortured day by day and dont have a peace of mind either..I would be really grateful and obliged.
