Hi Members,
I am working for a company based in New Delhi. I am getting the in-hand salary of Rs 19,000(INR) monthly. I know that it is a mandatory and statutory requirement for each and every organisation to issue the salary slip to the employee. THe Director-HR of the company is not issuing any salary slip to us whenever tried to contact him he said the salary will be directly credited to your salaried account. When ever i asked him for salary bifurcation he says that its a consolidated salary. Pl suggest what to do. I am facing a hell lot of problem at the interview because i cant produce a salary slip, neither i want to put up a fabricated salary slips in front of the other HR.
Pl post your valuable suggestions.

The only Act which have the provision of issue of wage slips to the employees is The Minimum Wages Act, 1948. If the unit is covered under this Act then the wage slips are required to issued to its employees a day prior to the disbursement of wages.Now coming to the point of definition of employee. According to section 2(i) of this act, 'employee' means any person who is employed for hire or reward to do any work skilled or unskilled, manual or clerical in a schedule employment in respect of which minimum m rates of wages have been fixed;and ----------. Your good self have not mentioned your designation & thus it may be possible that you may not be covered under this definition. At the time of interview may produce the offer/ appointment letter of the unit & the bank statement. If the slips are not disburshed under the proviso of this Act, the employees may make a complaint to the area State labour office i.e. the law enforcing agency.

Dear,
first of all let me know is there any letter given by company to you ? if yes, is it mention on the letter that you will be on consolidated salary per month for Rs.19000/- ? How much is your net take home salary then? are they deducting PF, P Tax, ESIC, LWF, or any other deduction ? this you will know from your net take home salary. Pls let me know this. I will try to help you out.

What your form 16 says ,if you are working since before 31st march 2009,did they deduct any tax and they have shown some allowances under tax exemptions?.
If you are getting credited your monthly salary into your account then there is no need to be worry,you have sufficient proof,only you asked about the salary contents to your HR department.
You can submit a complaint to your Top management against the HR personnel that they are not providing details of my monthly salary,if really you will not get your answer than attached your bank statement and send it to your nearest labour office by regsitered post against your company.
But why do you need details if they are not deduting extra taxes etc?
Before going to labour office for your complaint ,please think about your carrier too.

I have the same situation like you. I am getting salary around INR55000.00 with no salary slip but a deduction of TDS. I am with the company from last 9 years as an AM, a professional consultant not employee. I am getting the TDS certificate for every FY.
Is there any such deduction with your salary ? if yes than you are also a consultant not employee. Well I don't think it will create any uncomfortabel situation for future career. Afterall, our work experience is on the same field and the type of remuneration can not matter. We can show our tax certificates to declare the current package.

I have a similar situation.
I am working as a Manager in the company where my spouse is the director.
I am getting a salary of INR 52000 as Cash with no break up and no deductions. I am also not in the accounting books of the company. As the salary given to me is utilized back in business expenses.
Now i want to move to another company; how do i justify the same.
