I want to Know that what provision are laying in the PF or ESIC act for getting benefit in a case of death on duty, to the deceased family and what are the formalities need to complit by the employer or the family member of the deceased in this case

Dear,
In case of death of the employee Employer should inform ESIC office.Employer have to submitt a PM report,FIR copy,along with accident report.After inspection by inspector he will submitt his report to Department and procedure will get start for pension.

An employee expired while in service and he has not made any nomination on the PF portal. He got married recently. As per records his family members are - his father and mother while joining. Pls advice how to settle and whom to pay PF, Gratuity etc. At present his family members - Wife, Father & Mother.

The advisable course of action would be to get a joint claim by the members of the family along with a joint bank account and forward the related documents to PF & ESI authorities along with copy of the death certificate issued by the authority concerned for releasing the benefit thereunder. The gratuity could be deposited with the Controlling Authority under the PGA 1972 (the local Labour Officer). As regards unpaid salary, bonus, leave salary, etc., the amount may be deposited in the joint account.
In case the bereaved family is not able to agree on a joint bank account then let the statutory authorities decide the ratio in which it is to be paid and follow the same ratio with regard to the non-statutory payments.
