Please let me know that registration is necessary under Shop & Establishment Act under the following conditions --
1) We have one shop in mumbai where we are selling education & scientific toys. We have started this shop in January 2005. & the rent is been paid monthly by our sister concern company. As such, the Rent agreement is in the name of sister concern company. So, is registration necessary. If yes, then what documents should we provide & do we have to pay penalty for not registering at the time of starting the shop in January 2005???? We have only 1 Employee.
Please tell me As early as possible.

Dear tejesh,
The Shops and Establishment Act is enacted by the State, and in most cases it applies to Shops and Commercial Establishment having a specified number of employees or more. So, kindly find out that minimum number for Maharastra/Mumbai(if you have a specific act).

Thanks for the reply, Please see the attachment which I got from the internet which shows the fees as per the minimum number of employees. Please refer this attachment. And tell me whether We should apply for the registration ????? If yes then what document should we we provide as the rent agreemnt is in the name of the syster concern company.
[Note that we have opened the shop in mumbai in January 2005 with 1 Employee. So, do we have to pay fine also if we willl make registraion ???]

There may not be any penalty, since you are voluntarily opting for registration. There may be surcharge.
