Dear All, Is there any Gazette notification for filing NIL returns even though there are no employees covered under ESIC under S&E Act.
Our Corporate office is in Noida and they have ESIC covered for their employees as they have a factory there. But do regional office in Bangalore requires to obtain a sub code and to file NIL returns.
Please share the information.

1. Sir, when your unit is not having any coverable/covered employee, then the issue of preparation of NIL challan does not arise. However, to be on safe side, you can inform the appropriate office of Social security Officer, Branch Office Manager as well as Regional Office/Divisional Office of ESIC to which your unit is attached that at present your unit has no coverable /covered employee and hence there is no payment of any contribution.

So far as submission of Return of Contribution is concerned, at present the procedure has been changed to online and hence you can discuss the issue with the Branch Office Manager, as to how to file a NIL Return of Contribution. Otherwise, you can, in my opinion, also take action as mentioned in para 1 above.

1. Why NIL Return for ESIC?
a) If no return, then how come Esic would find the correctness of statements.
b) If any employee got demotion or 'less salary' punishment for certain period, and come under perview of esic ceiling for that period, then how esic would be intimated.
c) To file Nil return:
While filing online return, put NIL days and Nil salary against the respective employee and put the corresponding remarks as "Crossed wage limit". Portal will count the number of employess but contribituin amount as '0'. Same typeof entries for all employees who crossed 21000/- for transparency.
2. For paid challan, follow the procedure mentioned by Mr Udaya. Else, contact the nearest/respective SSO(Inspector), and ask for the online copy of C6 register from the disputed period to till date. You will get the challan nuber, creation date and paid date. In last page, you will get the details of miscellaneous challan details or details of defaulted challan details.
Otherwise you can show the proof of your bank details to concerned authority.
