Hi all,
I am new to this forum.
Wishing you all very happy networking.
I am looking for information on Leave rules in Karnataka Factories Act.
What are the leaves eligibility by an employee working in an Electronics manufacturing company?
Is he eligible for CL/EL/ML and if so how much it is and how is it calculated according to the Karnataka Labour and Factories act?
Can someone help me?

HI
To become eligible for leaves employee should have been worked for 240days in the past preceeding year.
After becoming eligible for leaves he will get 1 day Earned leave for every 20 days
and one day sick leave for every 30 days..
EL balance can carried farward for next year
SL Can't be Carry Farwarded

For the leave calculation, during a calendar year (Jan-Dec) for every 20 working days one leave is eligible.
If person join in the mid, for the remainder calendar year he should have worked two thirds days. Half leave to be taken as one day.
2. As for ML is concerned an employee should have worked 80 days preceding to her confinement. 12 weeks leave eligibility including pre natal and post natal.
II. As far CL & Sl factories Act is silent. You can form your own provisions

Hi if saturday we take leave,sunday is off,monday we take again leave........three leaves will be considered or two leaves

Dear Khurana, This is typically called as Sandwitch leave, it would be considered as 3 days leave.

there is some rule or it comes under some act,i got query from my employees.......... how to explain them. pls tell.........

a. An employee will be eligible for the Earned Leave only if the employee had worked for atleast 240 days in the calendar year or in the case of a new employee who has joined after 1st January of the said calendar year, if he has worked for atleast 2/3rd of the remaining calendar year.
b. While availing EL intervening weekly off and paid holidays are excluded
Maternity Leave:
a.Every female employees shall be entitled to Maternity leave for a period not exceeding 12weeks (6 weeks before delivery and 6 weeks after delivery) after she has worked for a period of not less than 80 days in the 12 months immediately preceding the date of her expected delivery.
b.All the holidays occurring during the leave shall be counted for the purpose of computation of 12 weeks.
c.Female employees covered under the provisions of the ESI Act will be eligible for maternity benefits / leave as under the provisions of the ESI Act.

as for the rules are concern there is no specific notification or law stating thet this many no of el leave can be encashed anywhere but there is a ruling that for every actual working of 20 days you earn one leave but encashment details are not there anywhere till date.
for matertnity leave its she should be in the employment 80 day prior to her delivery date to avail the leave. and casual leave and holidays are discretion of the company to give the no of days or fix the no days.
