Dear All,
Kindly clarify that, If an Employee getting a Salary <= 21000 covered under ESI, and
If Employee getting Salary >=21000 cover under GPA/GMC
Which employee is required to cover worker compensation? And is it Mandatory or not?

Employees are covered under ESI whose monthly gross other than conveyance is > 21,000/- per month. Employees with monthly gross < = 21,000/- per month is covered under ESI.

Employees who are not covered under ESI should be covered under Employee Compensation Act. GPA /GMC is not statutory item. But it may be extended by the employer as extra legal facilities. Covered under Employee Compensation Act if not covered under ESI is automatic. Now most of the employers are obtaining Insurance in lieu of EC Act to avoid liability of payment if any thing happen and compensation awarded by the EC Commissioner. In absence of insurance the organization has to pay of their own.
