This is related to the compensation in case of the employee met with an accident during and in the course of employment and due to accident he is partially / totally disabled / died then basing on his earning capacity / age / the part which got damamged / not useful to earn his livelyhood then under the Workmen compensation Act - 1923 the employer has to pay the compensation to the employee as per the act. The deputy / commissioner of labour are the competent authority under this act.
If the employee's salary is Rs. 15000/- or less & he / she is covered under ESI act then the ESI shall be liable and take care of the compensation part and the employer need not pay any thing. If not the employer is responsible, some time this compensation amount may be huge because of the death of the employee or many number of employees might have got affected and due to this some of the companies might have closed also the best example is the Union carbide case. To avoid this type of major issues the employers normally cover all the employees under workmen compensation policies which are with the New India assurance etc insurance companies.
