U/s 53 of the Insolvency and Bankruptcy Code 2016, workers' dues are topmost priority in distribution of the proceeds from the sale of assets. Implementation of Award of labour Court is generally done by filing an application u/s 33C of the Industrial Disputes Act, but if the insolvency and bankruptcy proceedings have already been launched, the workers' dues can be recovered in that proceedings.
