Could be please confirm what is the maternity benefit applicable to a working women in private company where No ESI. This i need to inform to my staff who is pregnant and want of information. My Co total staff strength is 7 nos. Pl advise!

Maternity leave is a statutory leave
 Expecting women employees are eligible to avail maternity leave
 Employee should have completed a minimum of 80 days of service to be eligible for
maternity leave.
 If you are on probation, you are entitled to avail maternity leave, subject to fulfillment
of the above mentioned condition.
6.3.1 Entitlement
 Paid maternity leave entitles is for 3 months or 90 days (although as per the maternity
Benefit Act, 1961, a women employee is eligible for 12 weeks or 84 days of leave).You
can avail a maternity leave of 12 weeks depending on your pre / post delivery
requirement. Full salary is payable during first 3 months of maternity leave.
6.3.2 Process
 You need to inform your supervisor that you will be preceding on maternity leave at
least 3 months before the date of delivery date.

Dear All advise the maternity leave should be extend from 3 month to 6 month in case of operation case of women employee and doctor advise for rest 3 to six month.what should be possible in this case
