If you are monthly rated employee then you will get 6th day as paid weekly off. Answer to second question will depend on why you want to count them.

Please tell actual issue. both the calculations are right 26 as well as 30.
we calculate workers salary on 26 and staff on 30. in case if you left your job without serving notice period and demanding the salary of following Sunday if you worked till Saturday. you wont get it.

Hello Shrikantbhai,
For Example, if Working days 26 days and Monthly days 31, and Present days of Salaried Employee only 23 days, then how to calculate salary for that employee?...

Hi,
Let's make it very simple. If you are working as a daily wage earner then the count of 26 would be taken as denominator factor and if you are an employee working on monthly salary then it would be as 30 or 31 depending the maximum number of days of the month.
Few companies have started some malpractice of adopting the denomination factor of 26 even in the case of monthly salary employe as any absenteeism or unapproved leave will save them a good amount when applicable on large base of employee absenteeism. There is no provision in the law to challenge this however it can be raised as an unfair labour practice.

Pay Period is any period of consecutive 30 days ( save and except the month of Feb) including Actual Working Days plus Days on which Weekly Off are allowed / availed by an Employed Person.
Weekly Off Day is One Day in each Calendar Week of 7 consecutive Days and is allowed / availed as per the Employment Laws of the Land.
Due to exigencies of Work, the Employer is allowed to use their "Discretion" to ask/instruct an Employed Person to defer his/her regular Weekly Off to another Day in the forthcoming following Week subject to the Proviso that the deferred Off shall be allowed /availed within Ten consecutive Days of continuous employment.
This is Humane and so also Lawful.

Dear Akshay ji
if u workfor 6 days in a week the last of the week should be a paid holiday for all workers..
this is is called as weekly holiday...
in every firm the Employer of the Estt. should give one day paid holiday to all his workers according to norms. generally if it is a factory he can give sunday as holiday. if it is a hotel or hospital or milk unit or any perishable production unit he can give individual weekly off.. for some sunday for some monday..like this...
calculation of daily salary is monthly salary devided by 26 ..it comes one day salary... ok
