Dear Sirs
One of our permanent employees met with an accident outside the Industry and received a head injury and got mentally derailed. He is a Machine operator in the underground mine. It is very risky to put him in the same job. He speaks irrelevantly. Prior to the accident, he was a very good operator. Please suggest to me, what is to be done with him ?. Can we terminate his services on the ground of his mental health?

Dear Khaleel Saudagar,

Technical or otherwise, medical fitness for the job is of utmost importance. Otherwise, the medical unfitness of an employee could jeopardise the safety of others. Therefore, identify the physical fitness requirements and if the employee does not meet those, then you may terminate the services of the employee. Before termination, find out whether the employee can be transferred to any other department.

However, business enterprises have a social obligation also. To fulfil the social obligation, find out whether any other family member of the employee like a spouse can be given some job.

try to give him some clerical job, and dont send him around heavy machinery, if something bad happens during job, your company gonna be in big trouble.

Prior to initiating termination process for your mentally unfit employee who met with an accident, please ensure he be examined before a medical panel constituted by your company. You may take action based on the recommendation of the medical professionals. Considering his length of service in your company and permanancy in the job, you may consider compensation to him appropriate for permanent partial or permanent total disablement, as applicable.

Also you can employ another family member of the employee towards your company's social responsibility, and commitment of your company towards the family of disabled employee
