Dear Shilpa,
I will not execute any joining formality of a person without relieving letter as the security of my organization is at stake. who knows a person might be working in two organization. It is quite possible that info will pass on.

Dear Shilpa,
If empolyee is joining without relieving letter,the employee can work one week or upto training period especially from competitors firm and chances of going back to previous company to continue his job.

Hi, i am M Sharma, had put my resignation from company on 19.12.08 with a notice period of 20 days. but the Senior Mgt tolds me, you don't need to give any notice period. your resignation has been accepted w.e.f same date.

but they hadn't realsed my salary for the same month and it's more than 3 months spent no releving letter issued by them.

what legal action i can take against my previos employer to take the relieving letter.

For your ease wriitng down the statement given in letter.

"You will be on probation for a period of one year and your confirmation will depend upon the satisfactory performanceduring this period.your services may be terminated without giving any notice and assigning reason during the probation period.On confirmation, your services may be terminated with advance notice of three months, in case you intend to leave the compnay, you will have to give the company a notice of three months. in case failure to give such notice you shall be liable to pay the compnay three months salary in lieu of notice period. if the notice period is shorter than the three month notice period, the same will be deducted from the three -month period and the salary has to be paid by you for the residual period of the notice period".

am i falling i above situation or i have the right to take action so i can get my reliving letter.

It is nice to know that the reason given for issuing Relieving letter is :
  • "who knows a person might be working in two organization. It is quite possible that info will pass on."
and;
  • "If empolyee is joining without relieving letter,the employee can work one week or upto training period especially from competitors firm and chances of going back to previous company to continue his job."
Now, the question that arises is:
If an employee is so dear to his previous company (or vice versa) what prevents him from re-joining his previous employer again ??
So, if the purpose of Relieving Letter is just to prevent such a situation; how does it perform this function ??
Warm regards.
