Hi, Dear all ! I am in desperate need to find the solution, a HR related problem presently I am facing. This is I, stay in Delhi and I joined a Mumbai based company with a branch office in Delhi. While serving for about 17 months at managerial level. Suddenly two months back my salary for the previous month was withheld without assigning any reason. and I was forced to resign immediately. Ultimately, keeping in view all pros and cons, I resigned in good faith that my earlier salary will be released. Full & final settlement after that in few days. Even after submitting my resignation after 2 months my salary has not released. I contacted our HR manager and I was told you will receive it with full & final settlement after 45 days as per company rule. Today ,even after passing more then 45 days I am continuously following with HR department but there is no satisfactory reply. Kindly guide me whom to contact in this situatio.:?:

Hi, Ask for explanation why your salary is withheld.Contact the person whom you were reporting to if not HR .Find out any dues from your side.You havnt mentioned the reason for resgination.Was it mutual?or its one sided?.Speak up.They should give a proper explanation why your salary is denied.First find out that.If there is no mistake on your part.Then we will be able to suggest more appropriate actions.

Thanks for responce. Is there any provision with company to hold the salery without mentioning the reason? I was made to resign without assigning any reason.Ya it was mutual,and after submitting my resignation the same has not been accepted till date. If you require more input please feel free. Hi Sandy, No company can deny or hold salary.There is no provision whatsoever.Send a letter through registered post with acknowledgement card stating your Date of joining,Emp no,Dept/Division,Date of releiving as such & mention your is salary is pending from such & such date & inspite of your repeated calls it is not being cleared till date.Dont forget to mention that HR or concerned person has assured salary after 45 days butstill pending.Ask for the reasons withheld.Any written communication will be addressed by the company.So dont send mail.Send a registered post with card. __________________________________________________ ________ You block your dream when you allow your fear to grow bigger than your faith.

Dear Sandy, You have mentioned you were working at a manegerial level, but as what? Were you into Sales or Marketing?? My company does have a clause in the Employee Manual that for sales/marketing/customer service if there is any outstanding payment from customers, then we can hold the final settlement till it gets cleared or it is adjusted in the full & final settlement. As for your query, No company can hold salary without giving reasons. So you have all the rights to ask for a reason.

Hey Sandy , Dont feel bad , you please go to labour court and send a notice to your employer for full and final settlement , i may suggest you one more thing if you have contact mail id of your MD., chairman or BOD then mail them mentioning your problem with the HR and mark that HR cc. ok then see how fastly they will release your salary. Indian Legal System is very lengthy and tough, so go to a known lawyer else for 50000 your total expenses will be 70000. So when going through courts demand a high compensation of Rs.2-3 lakhs for delay and mental harassment, and go to a known lawyer, may ur issue be solved soon , else take the wrong way and threaten the HR manager and break his bones,

Hi Sandy, Hey consult a lawyer & send a notice to your employer.He may be in a position to suggest which will be more appropriate.I will also get back regarding this. Have they given you experience / releving letter & dint pay salry only or is it both???Some comapnies do give experience letter but deny salary whatz ur case?? Check whether they have done PF deduction for you.If so do a small search in this website.You will get broad ideas.
