PSU Marketing Executive. Appointed presenting officer by disciplinary authority for domestic inquiry of charge-sheeted HR employee. Does the Presenting Officer have a role in initiating a Domestic Inquiry? If yes, then please elaborate procedure for initiating the inquiry.

The process of enquiry has three roles.1) one is the enquiry officer who is comparable to a judge in the court 2) the Prsenting Officer who is comparable to the prosecution and 3) the chargesheeted employee agaisnt whom the enquiry is to be conducted. Enquiry officer will fix the date for hearing. The presenting officer will first the lead the evidence against the chargesheeted employee which means he will be the first to examine witnesses and produce evidence in support of charges. after he concludes the evidence, the chargesheeted employee will begin his defence.

Does the Presenting officer need to prepare and submit to E.O. a case presentation based on the preliminary investigation report and evidences, thereof, leading to the charge sheet to the charged employee to begin the DI.
If yes, how to prepare the case presentation.

As presenting officer, you need to prepare a list of witnesses and documents on which you rely to present yur case as is normally the procedure in PSUs and a copy of it be given to the defence on the date of hearing. Thereafter, you should produce your witnesses first and conduct examination in chief and thererafter allow the defence to cross examine him. After the conclusion of evidence by both you(the presenting officer) and the defence , you need to submit your arguments either in writing or oral asper the procedure applicable to your establishment. It is an extensive subject.

It is a vast subject and cannot be taught in few lines or paras. Better, you get hold of a good book on domestic enquiry from the market by enquiring with book stores whos sell management and law books.
