Hi All, I am afzal I have doubt regarding the reliving letter of an abscond employee,

1) if employee has a genuine reliving letter of the organization that means he has not absconded?

2) after paying all due and FNF ( notice buyout ) can organization mark that employee as absconder?

Hi, If the employee is relieved after proper notice period with relieving letter issued by HR then the same cannot be considered as absconding case.

Employee have his reliving letter but employer mark him as absconder, does absconding employee got reliving letter or not, after paying notice buyout to employer does employer have right to mark that employee as absconder ?

Hi,

Official relieving letter is the proper proof that employee got relieved properly. Paying notice period amount alone will not be sufficient employee should get proper relieving letter. Employer marking employee as absconded case internally is their call. But employee can defend with relieving letter for future employments

Relieving follows the termination of employment, for whatever reason it is caused. An absconding employee gets terminated and thereafter the organisation can issue relieving order, indicating any sum or other things due. An absconding employee leaves the organisation without serving the notice period, the organisation can issue relieving order indicating the adjustment of the dues payable to the employee against the sum due. This is done in many government organisations/PSUs. Unless the employee is relieved, he/she continues to be on the rolls and can have a claim.
Thus it may be seen that an employee having a reliving letter could still be said to have absconded.
It is possible that even after paying all dues and FNF, still the organization marks that employee as an absconder.
