Greetings! Hope you all are keeping well.

I am working with a nice company, and I love what I do. But, from last few months I have been seeing various and difficult things going around us.

Peoples are getting sacked, even if their records are clean, and HR team is not cooperating at all, they have simply aligned themselves with management, they are randomly forcing people to quit and also using various methods to make people quit. I also have seen HR managers nodding their heads blindly and even sacking needy employees even knowing their families are dependent upon them.

I believe HR is their to help the employees, but they are doing the opposite. This is very disturbing. One common trick for them is to transfer a employee to a remote location, so that the employee quits himself. Sometimes also asking randomly to a person to quit. Their 1st priority is to save their own job, and hold a good impression to the management. They don't mind asking a employee to quit, covering their eyes.

Last week also they forced a person to quit....showing a reason of cost cutting!!!

My Questions are:-

1) how a employee can defend his job if he is holding a clean record, have no legal complain against him/her, have a good performance record, and have been working for more than 2-3 years in a same company?

2) how can one stop the HR malpractice?

3) what are the steps he/she can take with labour court or labour department or human rights org's to prove that she is being fired with no good reason?

4) if there any process to claim compensation from the company?

5) what are odd's if he/she walks in the above path?

**I know there are no Good or Bad Companies but Good and Bad Managers.**

Will really appreciate your responses on the above points.

From what you said I can understand that your company is a sinking ship. Very soon your company will declare bankrupt. Its better you put in your notice and start looking for another job. If it declare bankrupt they can simple fire anyone without any notice. Better be safe than sorry.

I can understand your problem,

Please find below my answers for your question

1. No company want to lose good manpower who generate revenue/ add value for them. Business agenda for them is to make good profit. so management expects everyone to contribute for the company growth as much as possible.

2. How do you know that Management is picking the employees randomly and sending them out. It might be having its own strategies to improve the department.

3. HR is definitely works for employees and as well as employers. HR is there is suggest the Management and tell them the causes and benefits of their activities, but remember management is the final decision maker.

4. If the employee is terminated or informed to leave by giving any reasons, they can always refer back their appointment clauses which will provide them what all the benefits they can ask from their management.

5. You can definitely sue the company but think practically,Company will hire a lawyer and they will move the case they can drag for years too. but employees need not waste the time bye running around the lawyers to proceed the case, and cost is also involved in this.
