As per my info -
i. an employee who, having been a member of the Fund, has withdrawn the full amount of his contribution in the Fund (a) on retirement from service after attaining the age of 55 years of (b) before migration from India for permanent settlement abroad; or for taking employment abroad;
ii. an employee whose pay at the time he is otherwise entitled to become a member of the Fund, exceeds Rs. 6500.00 per month;
iii. a person who, according to the Certified Standing Orders, is an apprentice, or who is declared to be an apprentice by the authority specified in this behalf by the appropriate Government. {Para 2(f)}

Dear Pradip,
As per PF Act an "excluded employee" means the following:-
1. Person joining any establishment with basic+ DA over Rs 6500 is an excluded employee and not coming under the perview of PF Act. There is no compulsion on the part of the employer to extend the PF benefit to him.
2. A person who has attained 58 years of age & has resigned/ retired from services of a company and has taked full and final settlement of his PF dues from his previous employer is an excluded employee. If he joins any establishment he will not come under the purview of PF Act.

Dear Sir, We want exclude a employees from pf. His basic is more than 15000. what is the prosger we should follow and which form take from an employee.

Hi,

An employee can opt out of the provident fund if the following criteria are met:

If he/she is a first-time employee i.e., at the time of joining the first job.

The employee has his or her Basic + DA (PF Wages) more than Rs.15000/- per month.

At the time of changing a job, only when he/she does not have an existing PF account number.


If an employee wants to opt out of PF, he/she can fill out Form 11 at the time of joining his/her first job. He/She will also have to present a letter addressing the employer stating that he/she wishes to opt out of the Provident Fund Scheme.
