Hi to all the seniors,

I was working in a Captive Unit of a Foreign Company in early 2001AD in NCR-Uttar Pradesh and after ONE month of my joining the service, they sent me a Speed Post/Registered saying that the Bachelor's degree copy submitted by me in the company is not genuine, and they did not even furnish any proof of the same to me. Whereas, it is absolutely incorrect and my degree is fully genuine. And in the letter/notice they also provided me time of 7 days to prove if my degree is genuine from the date mentioned on the notice i.e. writing the notice, but the same notice was received to me after 10 days of date mentioned in the notice, i.e.

( 10 - 7 = ) 3 days later than the last date provided to me to furnish the genuineness of my degree. As the last date was already over there was no time to prove genuineness of the said bachelor's degree, and I also have the proof of receiving the notice and the stamp of General Post Office is also there on the notice envelope which is of 10 days after the date mentioned in the notice, i.e. 3 days later than the last date provided to me for proving genuineness of the degree. So it has been around 3.5 years since they ejected me from office on the fake degree ground. This company conducts a 3rd party check and I think that the third party provided them wrong information, or might be the concerned University officers. I never worked in any company after ejection from there and was suffering from debt and mental sickness and trauma owing to loss of job on false grounds and defamation of being a fake degree holder. I also possess hospital tickets and doctors'/ psychiatrists' prescription of Govt. as well as Private hospitals.

As it has been 3.5 yrs now and I have never worked in any organization since then, however I withdrew the Provident Fund from the same company being under extreme fiscal distress,

1.)are there any legal remedies available to me now?

2.) Is it possible to get any compensation if I prove that they leveled a false allegation against me of furnishing fake degree for job? What is the procedure and what compensation can I get?

3.) Is it possible to obtain salary since they ejected me /terminated my services till the date of judgement in the court of law?

4.) Which competent authorities can I seek help from like Human Rights Commission, Ministry of HRD, any other, etc.

I thank all the seniors who would reply to my query and help me out in this painful situation with appropriate information.

Dear Zoya,
Why wake suddenly after 3.5 years? Why did you not prove the certainty of the same on receipt of the letter? Why did you remove your PF (assuming you wrote resigned on the forms)?
Also the world at large was not aware of the problem due to which you had left your job.
Cut the crap about mental trauma and such things? It was plain lethargy from your end that you did not attend any other interviews?
If you were so sure about your rightness you would have lodged the same years ago and not now? Leave self sympathy and start afresh...

You cannot do anything now. Forget the date on the letter, when a notice says you need to respond within 7 days, it does mean 'Respond within 7 days from the receipt of this letter'. Had you responded them within 7 days from receiving letter, things could have been different. Forget 7 days, had you responded even after a month, company might have considered you. But now it is too late.

Can you prove this that your mental sickness was only due to loss of job? No

Company never branded you a fake degree holder in public. They sent you a letter to prove your claim. You never responded. This no means can be called 'Branding'. There is no defamation here

Submitting doctors'/ psychiatrists' prescription would land you in even more trouble. Prospective companies would ask for fitness certificate to take you in. Even then, they will have reservations to hire you

Even if we agree your argument for the sake of it, you don't have any right as it has been 3.5 years. There is a limitation period of 3 years for these issues

The best thing is to forget and move on to a new job.

I am not saying your certificate is fake. The reason could be, the University from which you completed your degree was not a recognized one. In such case, you are a victim and can file suit against the University. I don't think limitation clause applies here.

Dear Zoya,
My friendly advice to you. Please forget the past mistakes, which were mostly on your part. You have lost precious three & half years of your currier by doing nothing, with such attitude you can't give any justification for your unemployment during the next interviews for job.I suggest please meet some good Psychiatrist & discuss your problem, you need psychological counsilling to come out of present stage. I wish you best of luck for your future.

What All our friends stated are correct. You lost precious years to take up your case in a manner what it should be. As an outside chance consult an advocate and give a try if this company still exists.
