Dear Seniors,
I am working as an HR Executive in a small IT company located in noida with 12-15 employees,According to the policy every employee has to serve 2 months of notice period after giving the
resignation. Recently one employee dropped an email of resignation stating he has got another good opportunity that is why he could not continue neither can serve 2 months
notice. Being an HR what actions i can take since it will take some time to get a replacement candidate for the same position.
Kindly reply with some suggestions.

This problem persist in the recent past and a lot of organisations suffer, this is the lack of attitude by the employee, and they are being wrongly guided by the other one who is willing to take the services of these employees in their organisation, secondly, they, the employee show meek respect for the present job, they are being pulled either with salary benefits higher than the present job or given some higher authority more than the present job for their experience, in both the cases, the recruiter is going to suffer because, these kind of employee show the same sense of jumping to the other job without considering the present one (offered). Thirdly, the present employer should motivate the employees and prospect of progress is wide open to them, absolutely, we fail to do this. Any how, as far as you are concerned, take stringent decision, never release his experience certificate, as and when the other employee get in touch for verifying the facts put the naked truth that the employee failed to serve two months notice as such we are not in a position to give a clean chit, inform the employee about the terms and conditions and direct him to report for the job immediately, never harass him, but, teach him what is work attitude, relieve him with respect so that he/she never forget your grace.

Thank you so much for your reply sir. Actually sir, the company in which he is planning to move is of his relative.I had already told him to serve the notice period properly and get his experience certificate but he is saying that he could not do so but would be needing the experience certificate.Moreover, he said he do not require any FNF from the company's end but could not serve notice period.

Dear Friend,
Assume, the employee moving to his relatives organisation, then what is the need of experience certificate, as regard financial platform the employee can manipulate for higher salary. Experience certificate is more and the most important then financial mentioning. Some organisation happen to consider financial statements like last pay drawn, some of the organisations sought for bank statements, salary accounts etc., in reality the experience certificate only show the continuity of work experience/service. Never compromise in this issue, ofcourse, some cases become compassionate and we have to consider yet, not for all.

Dear Kalyani,
You can take many actions against him but you can also not force anyone to serve the notice period. As told by you he is going to join the org of one of his of his relative, he dont require any supportive exp/reliving certificate from your side.
As concerned to action, you can legally write to HR of his Next Org regarding the Dual Employment Conflict, but remember one thing you should be perfect & Clean in Compliance.
But my advise is to stop wasting time on him, start finding his replacement.

Well, as you both said i did the same and told him if he cannot serve the notice period i wont
provide him with the experience as well as relieving letter.Therefore, on the same day he asked if i can withdraw
his resignation.
