Hi, I joined a newly formed organization (BPO), initially we were advised that we will only get 1 leave per month and the company will follow national holidays as per US that would be applicable till the company is registered, now its already been 8 months since the company is registered and neither the number of leaves have increased, infact we are not even getting the leaves as US national holiday.
The company has not even provided us with an offer letter, every time we ask about these stuff they just say we are working on it. Female employees are made to travel alone in night there is no transportation. There is no way we complaint about this, since there is no HR and the only point of escalation is the organization MD but they are the one making all these rules. I want to take some action but was hoping there are some ways to do this anonymously so I don't jeopardize my work. Please help.

Laws of India are applicable.Timings may be done as per USA but beyond that saying American laws are applicable is not in order.
You cannot remain anonymous and win the battle.
Some one will have to bite the bullet and ask for appointment orders, proper work timings and other requirements to be productive and in line with our labour laws.

Dear friend,
It is erroneous to hold that the Law of the country of origin would be applicable to a foreign branch of a Company incorporated elsewhere. The very name national holiday or festival holiday is location-specific. An American company can not deny its employees in Indian operations such statutory holidays applicable to India. Since your BPO comes under the Maharashtra Shops and Establishments Act, you can make a complaint to the State Labor Commissioner.
