Hi,
I am working in private company as HR Executive.
One employee joined in our company in Feb'07. After completion of probation period he was regularised and regular appointment order was issued w.e.f.01.09.2007.
He submitted his resignation on 10.10.2007. As per our company norm he has to give one month notice and so his resignation will be accepted and he will be relieved from 10.11.2007.
Now he has given medical certificate for leave from 12.10.2007 to 10.11.2007.
He has got no PL, SL, CL in his account.
Please suggest me as to how to deal this case.
Urgent please.

Dear,
In the case you present the employee applied for leave on medical ground for a month. logically medical leave period is not decided in advance. It is clear that the employee doesn't want to serve the notice period. You have right not to sanctioned his leave & may deduct salary in lieu of notice period.
One more thing that he has applied for leave after submission of his resignation, so served notice period days will be counted only for those days on which he has actually worked.
So, deduct salary for notice period & settle his full & final.

Q. What to do if a person is still in probation, having no leaves balance in his account, have taken the last salary during his sick leave period(nothing is due)?
:confused: shall we notice him to deposit his salary of 30 days.
:confused:shall we tell him to submitt an affidavit stating that he is not working anywhere else and when ever get well he will join back for 30 days.
or
anything else can be done to avoid that somebody else should not follow this practice infuture?
