If an ex-service man (from any of military services) takes up a job, after voluntary retirement with all of post retirement perks and facilities and benefits given to him by military, and then wants to apply for an exemption from ESIC, since he already has a medical card of military covering all of his declared dependants and direct blood relatives for all possible diseases and injuries, then is it possible? Here for assumption purpose we are considering his gross salary less than Rs. 15,000/- per month. In case if such an exemption is possible, then what is/are set of processes those are required to be followed by employee / employer to get such an exemption?

1. Sir, Ex-servicemen retired etc. from defence forces are not exempted from the purview of ESI Act, 1948 and rules/regulations framed thereunder.
2. The status of such employees will be as good as a normal employee and thus coverable/covered if their wages are within coverable limit as per wage ceiling.
3. However, necessary clarification can be sought from the appropriate Branch Office Regional Office of ESIC, if desired.
