Hi Team,

First of all thank you so much for providing very useful information.

I have any issue now.

2.7yrs back, I have joined in IT company (Ex: ABC)

They have deputed me to IT company (Ex. XYZ).

7months back XYZ company terminated ABC Company from vendor list.

As, XYZ management want me, hence mutual understanding between ABC and XYZ, they have put from other company called (Ex DEF) and my payroll is with ABC still. (XYZ Company has vendor of DEF Company)

Now XYZ Company has offers me permanent position. I would like to apply for the position. But in my offer letter.

It was mention as below.

“During the course of employment with the company and for a period of 2 years after termination the employee shall not accept any offer of employment from any customer or the customers end-user customer of the company and shall not either directly or indirectly, either for oneself or for any other person, firm, company,or coporation, solicit, divert, or take away any of the existing customers of ABC.”

As now ABC and XYZ companies don’t have any business or any relationship.

Please let me know, if i joined in XYZ as permanent employee. While there be any legal issue. After getting reliving letter from ABC Company. (ABC was not giving NOC to join in XYZ).

Please let me know, if there is any alternative to join in XYZ company as permanent role.
