I need a help because i wrongly taken esic number on previous date (Before 10days of his joining) but joining date will be same when i taken the esic number . How can i reply and take new esic number of those employee.

Full details are not provided to consider suggestions. However, pl.meet the concerned RO/Inspector(s) take their advice. They'll guide you what to do in the circumstances explained. It's already late for many in this thread.

You need to produce appointment letter of the said employee/s along with no accident report, muster roll, salary slip etc... to the concern office. Also, declaration form received from department.
Covering letter mentioning reason for late registration.
I hope above will suffice your requirement.

Dear Friends,

In this thread, the first post was made on 17.01.2020. The poster must have, by this time resolved the issue. But he is not contributing here his experience in resolving the issue.

In the SCN, it is mentioned that unless you submit the proforma / declaration form duly filled in and signed by you along with the documents listed there-in within 15 days, the ESI Corporation will constraint to considered the date of registration as date of the joining of the employee. And thus you will be liable for legal action for non-registration of the employee between his date of joining and the date which is considered as his date of joining by the Corporation. You are not allowed to pay contribution for this period.

This is meant only to make harassment of the defaulters registering employee under the scheme after 10 days. This is the only source the Corporation Officers are having today to make money and they will not leave you like that. Places like Mumbai the demands are exorbitantly high. You are threaten for serious consequences by not allowing the registration from actual date. If you have many cases of late registration, then you are finished.

The documents which are demanded, many of them are readily available with the department but still you have to submit it. The information you supply through the proforma / declaration form is mostly available in portal. The Corporation is also asking form you the copy of SCN with the proforma / declaration form and a copy of TIC.

So ensure the registration of IP in 10 days time from date of joining.

Dear Friends,
Today also I came across one case wherein an officer is harassing defaulter employer of registering employees under the ESI Scheme after 10 days.
During the pandemic time, the officer is expecting the defaulters to meet him personally again and again with various documents hard copy and threatening him for legal prosecution including filing criminal case against him.
Is it not contrast to the Corporation directives to have personal hearing of cases under Section 45AA of the ESI Act through video conference till 31.12.2020 and receiving all documents by way scanned copies via mail or by post?
