Dear Seniors,
I am working as HR in a BPO. We usually credit salary for our employees on 7th of every month. Last month (on 6th june)we terminated a employee for attitude problem, and we told him that his salary will be given on 10th of august with final settlement papers. But yesterday I got a call from a person saying that he is from Human Rights Commission and said that the terminated employee filed a complaint against the company, as we cheated him regarding salary. I am in confussion that how Human Rights involved in this issue.
My doubt is 1. Can he approach Human Rights Commission for salary issue?
2. As a HR what further steps will I have to take? ( We will give his salary on 10th of august for sure)

Human Rights Commission??? Cool... So there is an avenue... he is jus buck-passing you... bundle of lies... hr never gets scared, it scares pple instead...

i am not able to understand the law followed by BPO .these BPO makes their own law.
you tell me why you will pay his eraned salary even after termination in august.as per payment of wages act salary to be paid by 7 th of next month.there is a provision of penality under section 15 of payment of
wages act.
which law permits you to take 60 days for full and final settlement.
BPO adops this practice because the people work there are educated and donot want to go for litigation.
he should approach to labour dept for this purpose.however one can approach to human right commission if company is humilating a person .
in my view this is humilation only.
dear donot mind but it is actual fact ,in other industry you can not think of adopting this practice.

Whether the ex-employee goes to human rights commission or to labour deptt. this is secondary issue and can be disturbing to the company if he goes there. But sincerely if any body leaves the company it is advisable to clear his account on immediate basis to get rid of the dirt as you have mentioned. Longer the time you take to clear his account longer the time dirt will be thrown on you and your company time and again.
