Employees of educational institutions which are not state owned or state aided are covered by EPF and ESI subject to the coverage rules prescribed therein. Subject to state amendments teachers are not covered by Payment of Bonus Act. Similarly, Payment of Gratuity Act is also applicable to employees of educational institutions who are doing administrative functions. However, there is a move to amend the Payment of Gratuity Act to include teaching staff also under the coverage of the Act.
Educational institutions not covered by states service rules and having registered under the State's Shops and Commercial Establishments Act will have to follow service rules prescribed by the said Act. As such some other Acts such as Payment of Wages Act, Minimum Wages Act, Maternity Benefits Act and National and Festival Holidays Act (state Act) will also have direct bearing on educational institutions.

Wef 29th December, 2010, All private Educational Institutions in T.N. where 20 or more is employed is covered under ESI Scheme vide T.N.G.G. dated 29th December, 2010. For more details contact S. Srinivasan @ 9444080385. For Factory Laws Applicable in Tamil NAdu (Labour Laws) - presently it comes in Five Volumes and priced Rs. 3900/- plus postage etc. Teachers are brought under the Purview of Payment of Gratutity effect with retrospective effect from April, 1997 (thru Amendment of the Payment of Gratuity Act).

I hope this post finds you all in the best of your health. I recently came across some news from a source that from April 2011, schools have to pay 6.5% of amount expended on school maintenance (e.g. whitewash, repairing, etc). Can anyone please throw some light over the issue.

Sorry,I have no idea about it. That also a contribution of 6.5% every year is a big amount and there may be institutions which will think of doing no maintenance at all just to avoid it!!
Also hope it is not like any cess or contribution towards any welfare Fund instituted by the School itself so that the management can charge or recover it from the parents by way of FEES.

You have to pay for ESI contribution on 6.5% as of total employee and employer contribution towards labour charges paid. The payments paid for labour and labour with material as per your accounts and vouchers are covered. If only labour with full amount and labour with material will be approximate share on the nature of work.
To avoid this contribution you can engage with only the contractor who covered or exempted in ESI contribution and you have to collect a copy of the relevant proofs to submit at the time ESI inspection and audit.
