Washing allowance comes under which Act & which employees are eligible for it ?

Generally speaking, the splitting-up of wages/salary payable to employees into basic and other allowances is a subject-matter of collective bargaining on wage determination and wage revision. Even in such negotiations the types of various allowances and their relative proportions to gross wages are determined by various factors such as the extent of the indirect financial commitments incurred by the employer towards social security obligations and other fringe benefits, periodical direct financial implications on a/c of the raise in the cost of living, additional and special expenses to be incurred by the employees by the nature of their duties, place of employment etc. Washing allowance is one such allowance payable to the employees on a/c of the compulsion to wear uniform. To my knowledge, there are no statutory prescriptions.

As per my knowledge, there is no such acts demanding the necessity for paying uniform allowance. But it is quoted in ESI Act that, washing allowance is a sum paid to defray special expenses entailed by the nature of employment and as such this amount does not amount to wages.
I have read somewhere that till November 1995, there was a prescribed uniform for public sector units (PSU) and there onwards it has been decided to discontinue it. However, the practice of paying the uniform allowance to the employees continued and treated it as exempted pay. From March' 2010, a proper dress code has been laid down to such employees who receives the uniform allowance.

As you have not mentioned type/sector of industry working. Though please refer Factory Act, 1948 (where 10 or more (electricity consumption) and 20 or more (without electricity consumption) employees working.
