There is some misunderstanding, maybe, when the contract workers raise an industrial dispute, the stand taken is there is no employer employee relation between co. and workmen, but I.D. act is applicable to all establishments that come within the purview of industry as enshrined in the judgment of bangalore water supply and sewerage board, which encompassed even tirupati devasthanam to be an industry.

The Industrial Dispute Act extends to whole of India (Except Jammu and Kashmir) and applies every industrial establishment carrying on any business, trade, manufacture or goods and services irrespective of the number of workmen employed therein. Every person employed in an establishment for hire or reward including contract labour, apprentices and part time employees to do any manual, clerical, skilled, unskilled, technical, operational or supervisory work is covered by the act.

If there is the concept of Employee-employer relation between the principal employer and his
employees engaged through contractors then they fall under the definition of workmen under ID Act.Otherwise not.An worken under fixed term contract directly with employer will be his workmen.Hence be careful while entering in to a labor contract with a contractor.

The ID Act is applicable to all workers. The difference of the nature of relationship between the Employer , Principal Employer , Workmen & Contractors Workmen will decide the applicability of the provisions of the act and respective rules.

But dispute should related on the issues of wages, welfare, compensation, etc. Disputes resolved through the statutory bodies amicably. In view to disputes should not lead to violation in industry. All industrial acts are enacted and created to smooth running of the society in prosperous way.
