Dear rashtra,
well it depends the kind of image he has in company and off course is he followed all rules and regulation after putting up his resgination. If yes he has done all the formalities then company may think of waiving off his notice period.

Sub- Notice period waiver
It is within employer's discretion to waive or insist on notice period for resignation.
An employer may waive a notice period
1) having regard to the long service of the employee
2) having regard to unblemished service of the employee
3) having regard to the contributions made by an employee
4) having regard to the humanitarian consideration of compulsions of the employee for leaving service
These are few reasons.

It depends on the merit of the case. But it is not advisable on the company point of view. Rules are meant for all employees in uniform. NP is meant for smooth transition and any waiver unless on health grounds, the very purpose of inserting the Notice period clause in the appt letter is defeated which I opine.
