The company follows 3 days leave policy if a leave is taken on Saturday and Monday. Suppose a employee has 2 compensatory off in the same month. If the Compensatory off is adjusted on Saturday and Monday,whether 2 days leave or 3 days leave is considered?.

Hi deepak, nothing to worry about comp-off and leave rules. If you are happy with the staff you can give both comp-off on sat and mon so no leave can be deducted. Leaves does not have any fixed rules. Purely on HR and managements discretion.

Compensatory off and leave are two different things and not the same though in both cases an employee is authorized to remain absent and thus compensatory off is outside your leave policy and therefore in my view an employee can be permitted to take compensatory off on Saturday and Monday without clubbing Sunday.

As I understand the post after your clarification, you are talking of what is called sandwich leave rule, where a Sunday is counted as a part of leave when an employee is on leave both Saturday preceding and Monday post the Sunday.
That rule is a valid standard rule followed by HR in many companies.
However, the rule is for leave taken / granted in the normal course, consisting of PL / CL / SL or even LWP.
However, in my mind, compensatory off is a different category of leave, that is granted for having worked on holidays or weekly off. Putting a sandwich can rule with this may be in the policy but unfair. There is no rule of law either supporting or disallowing the rule.
If you have more than 50 employees, then I would suggest that you ensure the rule is a part of your standing orders and clearly worded to avoid a dispute.
