Hello Sir, I have a clean record of working with all my past organization except the previous one. I have worked day and night for my previous organization and they also appreciated it. But when i put my resignation(duration 12 weeks) after 20 days they offered me good package but i rejected and then afterward they started harassing me and keep on assigning me new tasks and pressurizing me to complete all the new tasks in the notice period which is not possible. Anyhow i completed 70 days and end of the month they hold my salary and didn't even inform in advance until it was on payday i asked hr and she informed my salary is on hold due to policy change and will provide me after completion of my notice period. I had already home loan going on and i requested them explained them my situation but didn't provided me salary. So i was left with no choice to leave the company and i mailed them for same.

After some days i ask them via mail to provide my pending salary and form16 and after series of conversation, they provided form 16 but not pending salary.
They mailed my new employer that i have absconded my current organization and gave them bad inputs even though new employer didn't ask them.

Also, they blamed me of dual employment. I and my family are in mental distress and my previous employer is on verge on ruin my career
Also, this not only happened with me lots of people have left that organization due to toxic work culture and they have harrased lot of people
Note: i was onboarded to my new organization while serving notice period but i joined the new organization after i left my previous employer and my appointment letter shows same i.e i joined my new employer after leaving previous one.

Dear member,

Though your post is long, it does not say anything about the requirement of serving the notice period mentioned in your appointment letter, and whether or not you completed the notice period. If you have not completed your notice period, then you have weakened your case.

Yes, you are eligible to get the salaries and wages till you had reported for your duties. The employer cannot hold the salary. However, it is a different matter altogether. For the former employer, yours will be a case of "abandonment of employment".

My notice period was of 12 weeks as per appointment letter with my previous organization. I completed 70 days along with working on weekend and till late night
I was harrased and pressurized to work and they hold my salary and i was really tired of all this
I told them that i left their organization because they didn't provide me salary.
Also from other sources they are threatening me to take legal action against me.
Due to this me and my family going through mental trauma
