Dear Seniors,
I am Neetha and I am working for a IT Company. There is one issue that has to be solved.
One of our senior employee has given the resignation, but our directors have not accepted the resignation yet.
I would like to know whether the concerned person has to serve the notice period on the basis of Date of Resignation or from the Date of Acceptance.
Please seniors, help me to sort out this issue.

Hi Neetha Always Notice period stands from the date of issuing resignation letter. Its not on date of acceptance

the date he has mentioned in his resignation letter.. from that day he will be on notice period..
he has given his papers,if directors are not accepting thats not an employees problem.

Hi Neetha, Greetings for the day! The concern person has to serve the notice period, on the basis of 'date of his resignation' letter.

First of all what is the issue that your boss still did not accept his resignation letter? and second the resignation letter once can be effective once that your boss sign his resignation letter and than through a formal letter you can inform him for his resignation letter and the paper work that he needs to do it such as handover , final due , ID Card , Office equipment and such a these thing (Clearance Certificate) in order to be more formal and in the future he can contact you freely for reference check however as you said he is working in senior level and he needs to compromise with the CEO and leave the organization in a good manner

Dear Neetha,
His notice period starts from the date of his resignation & not from the date of acceptance. The employee can withdraw his resignation at any point of time but his service period is to be considered as notice period after receiving resignation letter.

Every appointment letter / offer letter mentions that the employee has to give a "notice" of x days / y months if he / she wants to resign from the company. So if the employee has given the "notice" to resign, it starts from the date he hands over the same to "competent" authority.
I also am sure that no appointment letter mentions that the resignation notice will be deemed to be effective from the date it is accepted by the management. If and only if such a clause exists in the appointment letter and the same is accepted by the employee can a situation arise where the effective date of the resignation will be the acceptance date and not the date of the resignation. Otherwise, as everyone has mentioned above, the notice period starts from the date the notice is given in writing.
