Hi,

I have planned to resign from my current role for not getting growth in last 2 years, My base location is Noida and my reporting manager in Mumbai. I have received a wonderful opportunity from an organisation, where they have offered me the growth I wanted. But they want me to join on immediate basis and not ready to adjust, therefore I somehow convinced them to join within 70 days.

But main problem is the company where I'm working as of now, has notice period of 90 days which non negotiable as per policy. I spoke to my Manager but not getting any support at all, they're asking me serve the entire notice period but my next employer in not ready to wait.

Basis discussion with the HR, she suggested following outcomes

1. If you don't serve 90 days and want to leave early, we will issue relieving letter.
2. The catch is a special clause will be mentioned that X employee has a notice period on 90 days but he stopped reporting after 70 days.
3. I will also have to pay for notice shortfall, which I have agreed to pay.
4. The company will never re-hire me again.

My next employer does not have any issue with the clause, Now please enlighten.

a. If I'm going face any challenge/hurdles in future basis the clause being mentioned in the reliving letter.
b. Is this ok since I can justify that I was not absconding but paid for notice shortfall and got relieving letter as well.
c. is it just that the clause is mentioned on letter apart from that I have completed handover and all the exit formalities.
