Dear all, I have following queries regarding consultant services agreement:
1. Is it reasonable and practical to add the clause of advance payment?
Means a client should pay at the beginning of every month.
2. In case of delay in payment, how much interest or amount should be charged?
3. What are general conditions of termination of consultant agreement?
4. In general, how frequently should a consultant visits a client?
5. In general, how many hours should a consultant spend at client's workplace?
6. In India, I want to know the average rates/fees of HR consultant/partners for delivering their services to:
1. Single project of 3 months
And
2. Year long services

You have asked so many questions but then you have not written what type(s) of consulting services will you provide to your client. What is the length of your experience and what special knowledge or expertise do you possess?

Who can be a consultant? A consultant is a Subject Matter Expert (SME) of some specific subject. The expertise is acquired because of the exposure to the functional activities for a long time. Additionally, a consultant is expected to know the dynamics of a particular industry.

Against this backdrop, the consultant has to decide what would be the parameters of his/her services. He/she is a seller and should know how to sell his/her services. The seller sells his/her knowledge, therefore, it cannot have common boundaries that are applicable to the employees.

In view of this, I recommend you doing market research of the industry that you are going to work in and identify who are the best brands. Benchmark against those brands and fix your own price.

Therefore, I recommend writing down the replies to the questions on your own and preparing your own proposal. Send the proposal, pursue with the client and the client will call you for the meeting. In the meeting, let the terms of services be negotiated. Once both the parties agree, you can make an agreement.

In the agreement, it is important to mention how both the sides will maintain records to generate the proof of the services, what will be the method of providing services and what will be the payment terms. After entering the contract, let the client issue you a Purchase Order (PO) for the first time. Let the validity of the PO also be mentioned.
