Dear vasant nair in reply to ur suggestion, nothing was issued to him at the time of his appointment as he was entered the org. as workman at that time with someone reference and moreover as u have written about offer letter and personal file what if they are not issued or maintained his name is alrealdy there in registers which are required to maintained under labour laws n many returns are filed till date and it will trace out from there to that he is employed by us hope now u clear about it.

Dear as u have written about leaves let me make u clear yes u can give all three leaves, provision regardind earned leave is given under factories act see Sec.79 every employee who has copleted 240 days in preceeding year is eligible for earnd leave in current year one leave for every20 days work and regarding casual and sick leave every employee is eligible for minimum 7casual and 7 sick leave if ESI is applicable in that case sick leave is governed by ESI Act hope ur query answered now.

I am afraid I have not made any suggestions at all with regard to isue of any letter etc....
I have, on the contrary suggested that such suggestions made by some other member (Bhagwan-07) should be avoided since they are rather childish and improper.

First we have to understand the cause for the change of behavior of an employee is due to internal or external factor. If it is due to external, employee will be held responsible, if it is internal problem then he should be given a notice to change himself with directions. If at all the same behavior continues then employer has right to take an terminating action. Every human being for an organization is an asset, that to employee of 15 years should be more valuable asset in terms of knowledge.If the attendance is signed continuously more than 3 years he is eligible to take this matter in the court of law.
