First u give a 15 days notice to submit explanation on production of false certificate. His services were regularised based on performance. He joined with fake certificates. Besides, criminal case is to be registered against him in the police station for producig fake certificate. After receipt of explanation within 15 days his services are to be terminated as per Law. If he has not submitted his explanation you can terminate him as per proceedure. Several Apex Court Jugements are clarified that before terminating to an employee you should give chance to submit his views. Otherwise legal complications will attract. Ur action to be as per Rules but not precedents.

Dear, You have the right to terminate him/her. But if possible, try to find out a second way.. you can punish him/her. If he/she is giving his/her best... just try not to terminate... DK
