I am in the process of setting up a new cashew processing unit at Ratnagiri MIDC in Maharashtra. I will need about 20-25 employees on the payroll whom I will recruit on my own, and approximately 200 laborers for whom I will engage a labor contractor.

My question is, 'can you please help me with some sort of checklist that I can use as a base?' This is mainly to ensure that I follow all legal steps and comply with all norms right from the start to ensure proper corporate governance in my HR setup.

Please guide.

Following are the compliance issues that you need to take care of while setting up your HR department:

1. Minimum Wages
2. PF (Ensure that your labor contractor fulfills PF and ESI compliance because, if they fail to do so, the onus will be on you.)
3. ESI
4. Working hours
5. Prohibition of child labor
6. Holidays
7. Leave Provisions
8. Committee against sexual discrimination
9. Overtime and Bonus
10. Equal remuneration compliance
11. Maternity benefit compliance
12. Contract labor regulation
13. Fire safety norms
14. Health provisions in the factory: Cleanliness, disposal of waste effluents, ventilation and temperature, dust and fumes, overcrowding, lighting, drinking water, latrines and urinals, and spittoons.
15. Safety provisions: Fencing of machinery, work on or near machinery in motion, employment of young persons in dangerous machines, self-acting machines, prohibition of women and child labor near cotton openers, revolving machinery, pressure plant, protection of eyes, and appointment of a Safety Officer, etc.
16. Welfare provisions: Washing facilities, facilities for storing and drying clothing, facilities for sitting, first aid appliances, canteen, shelters, lunchroom, restrooms, crèches, and appointment of Welfare Officer.
